Who we are – Envirotivity Services.

Welcome to Envirotivity! We are an aggregation and registration platform dedicated to bringing people together through nature-friendly experiences. Through our platform, we enable Greater Sydney residents and event organizers to create, discover, share and register for events.

Who’s Who.

When this Privacy Policy uses the term “Organiser” we mean event creators using the Services to create events for consumers using our Services (a) to consume information about, or attend, events (“Consumers”), or (b) for any other reason. Organisers and Consumers are referred as ‘Users’.

Our Privacy Statement.

We take the privacy of your Personal Data seriously. Because of that, we have created this Privacy Policy. Please read this Privacy Policy as it includes important information regarding your Personal Data and other information. When you use or interact with us through the Services , we may collect Personal And Non-Personal Data, sometimes for our own purposes and other times on behalf of an Organiser using our Services to run an event. 

Envirotivity will collect only information than is necessary for it to fulfil these functions, unless required by law, ensure that any Personal Information collected is relevant to Envirotivity’s purpose, is accurate, complete and up-to-date. 

Envirotivity will collect, store, use and disclose Personal Information in accordance with the Privacy and Personal Information Protection Act 1998 (NSW) (including the Information Privacy Principles (IPPs)) (PPIPA), Privacy Act 1988 (including the Australian Privacy Principles (APPs)) (Privacy Act) and any other relevant laws and codes of practice in operation from time to time including the GDPR.

 Information collected by the Envirotivity is intended for use by staff in the marketing, communications and web teams. 
Under the Privacy and Personal Information Protection Act 1998 you have the right to access and change personal information that the Envirotivity holds. 

Data collected by Envirotivity.

Data that in some way identifies the user is gathered during interactions with Envirotivity websites in the following circumstances: 

Computer information. 

It is a necessary part of visiting any website that your web browser provides your machine’s identity (IP address) to the web server so it can address the reply to the correct machine.  We automatically collect certain technical data that is sent to us from the computer, mobile device and/or browser through which you access the Services (“Automatic Data”). Automatic Data, includes without limitation, a unique identifier associated with your access device and/or browser (including, for example, your Internet Protocol (IP) address) characteristics about your access device and/or browser, statistics on your activities on the Services (navigation and clickstream data), information about how you came to the Services and data collected through Cookies, Pixel Tags, Local Shared Objects and other similar technologies.

Personal and Subscription data .

Personal Information is defined by Australian and New South Wales Legislation and Privacy Principles as namely information or any opinion, whether true or not, and whether recorded in a material form or not, about an identified individual, or an individual who is reasonably identifiable from the information or opinion.

Personal Information is also defined by the GDPR in which we provide particulars namely:

For all Users we collect Personal Data when you voluntarily provide such information to the Services, such as when you register for access to the Services, contact us with inquiries, respond to one of our surveys or browse or use certain parts of the Services. The Personal Data we may collect includes without limitation your name, address, email address and any other information that you choose to provide and/or that enables Users to be personally identified.

Personal information user provide when registering for email newsletters will only be used for the purpose indicated for that particular service. 

When you register for an event, sign up for communications, enter a contest, or otherwise input your Personal Data (such as through a web form) to communicate with an Organiser or participate in an Organiser event, that Organiser will receive that information.  Organisers can set up event registration pages to collect virtually any information from Consumers in connection with registration for an Organiser’s event listed on the Services. Envirotivity does not control an Organiser’s registration process nor the Personal Data that they collect. When you register for, or otherwise provide information to Envirotivity in conjunction with an Organiser event or activity, whether that information is yours or a third party’s, in connection with a registration, or transfer, that Organiser will receive and may use the information you provide.  The Organiser may then send you marketing or other communications, which may be subject to its own, separate privacy policy. Likewise, if you provide your mobile phone number, you may receive information messages related to the service, event, activity or information in which you’ve expressed interest.

We are not responsible for the actions of these Organisers, or their Third Party Organisers (or other downstream recipients of your Personal Data), with respect to your Personal Data. It is important that you review the applicable policies of the Organisers, and if applicable and available, their appointed Third Party Organisers, of an event (and the related fundraising page, if applicable) before providing Personal Data or other information in connection with that event or related fundraising page. Similarly, if you are a member of an Organiser’s organisation within Envirotivity , your Personal Data will be available to the Organiser and shared with those Third Party Organisers granted permission by the Organiser to view all members of the Organiser’s organisation.

Photography and Videography

Envirotivity may commission photographers to attend events, famils and activations in order to photograph the event, family and activation and the general environment. This will include images and footage of patrons and participants for the purpose of using them in our promotional or marketing material (including any publication) in the future.

In some circumstances, images or footage may constitute as personal information. The image or footage may be reproduced on our websites, or reproduced in communications via hard or soft copy. The terms and conditions of all our activations, famils and events include the use of images and footage for these purposes. It should be noted that Envirotivity is not responsible for any activities of the media or other patrons in relation to the display or communication of any footage or images at any event, family or activation.

User feedback.

We seek feedback from our website users to improve the information and services provided on the site. Providing feedback is voluntary and does not in any way affect your access to this website. Personal information may be used to reply to your question or comment. 

Cookies

We manage some aspects of your connection to this website using a facility called a cookie, to enhance the user’s experience of the site. A cookie identifies and recognises the computer but not the person using the computer, when you visit some parts of our website. A cookie is a small text file that is sent back to your computer’s hard drive from a host website. Children’s Online Privacy Protection Act.

We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data through the Services without their permission. If you have reason to believe that a child under the age of 16 has provided Personal Data to us through the Services, please contact us and we will endeavor to delete that information from our databases.

If you are aged 16 or under, you need your parent or guardian’s permission before you provide personal information to the Envirotivity through our website. Users without parental or guardian consent are not allowed to provide us with personal information. 

Information Collected From Organisers.

If you are an Organiser , you are required to provide some personal information to submit an event for publication on this website, including name and contact details.
The purpose of collecting this information is to allow Envirotivity team to contact you about your event listings, account or feedback to optimize our website. Some personal information (e.g email) is also required to allow event submitters to maintain an account with the site and to edit their events.
Supply of this information is voluntary.

How We Use Your Personal Data.

We are not in the business of selling your Personal Data. We consider this information to be a vital part of our relationship with you. Therefore, we will not sell your Personal Data to third parties, including third party advertisers. 

We collect and use the Personal Data we collect in a manner that is consistent with this Privacy Policy, and applicable privacy laws.  The staff who maintain and operate the Envirotivity website are subject to the Privacy and Personal Information Protection Act 1998

Where you have consented to receiving marketing communications from us, your consent will remain current until you advise us otherwise. In the event you do not wish to receive such marketing and promotions communications, or you do not wish for your information to be used, you may opt-out using the unsubscribe mechanism contained in the communication or by contacting us via the contact details at the bottom of this policy.

We may disclose your Personal Data to a third party if required to do so by law in order to (for example) respond to a subpoena or request from law enforcement, a court or a government agency (including in response to public authorities to meet national security or law enforcement requirements), or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect or defend our rights, interests or property or that of third parties, (c) prevent or investigate possible wrongdoing in connection with the Services, (d) act in urgent circumstances to protect the personal safety of Users of the Services or the public, or (e) protect against legal liability.

In addition, as we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganisation, dissolution or similar event, Personal Data may be part of the transferred assets. We may also disclose your Personal Data in the course of due diligence for such an event. You acknowledge and agree that any successor to or acquirer of Envirotivity (or its assets) will continue to have the right to use your Personal Data and other information in accordance with the terms of this Privacy Policy.

If we intend to use any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time the Personal Data is collected or we will obtain your consent subsequent to such collection but prior to such use.

How We Store Your Personal Data.

We may store Personal Data itself or such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy. We take what we believe to be reasonable steps to protect the Personal Data collected via the Services from loss, misuse, unauthorised use, access, inadvertent disclosure, alteration and destruction. However, no network, server, database or Internet or email transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us electronically. Please keep this in mind when disclosing any Personal Data.

How long we retain your data. 

Envirotivity will store your information as per the data retention laws in Australia, or as applicable. We may retain your Personal Data as long as you are registered to use the Services. We may retain Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes.
